First IDF Soldier Prosecuted For Refusing Evacuation Orders

As previously reported on Israpundit (here), a neighborhood evacuation occurred in the Shomron (West Bank) settlement of Yitzhar (located overlooking Shechem [Nablus]).

Two buildings on Givat Lehava (the name of a local hilltop and new neighborhood) were forcefully evacuated and demolished.

Chabad Hossid & IDF Soldier Yosef Pielant, a resident of Yitzhar, approached his fellow soldiers, in uniform (as he was on active duty though on a brief leave) and called upon his fellow soldiers not to follow the orders to evacuate and destroy the houses and buildings. Yossi, who serves in the Charuv brigade, was arrested by his senior officers.

Following the rules of IDF military justice, soldier Pielant requested his case be transferred and ajudicated by the military police instead of the Chief of Central Command, who is known to be very anti-objective in his views. However, he was tried in the presence of his commanding officers after his request for a trial before a military court was rejected. He was sentenced to 28 days in a military prison for "unsuitable behavior."

Lawyer Shai Galili, who is representing the Chabad soldier Yosef Pilent of Yitzhar, the first soldier to resist carrying out evacuation orders, has submitted an appeal. He claims that the court proceedings have so far been illegal. "This entire ridiculous process that has been going on can in no way be considered anything like a hearing, let alone a fair trial. Everything has been done in a fictitious manner and my client (Yossi) has not been given any real chance to defend himself against the charges brought against him," stated Galili.
