1. Throttling legitimate dissent I

From Arutz 7, under the heading, 'Cabinet Approves "Big Brother" Unit':

The Cabinet has approved the establishment of a special Justice Ministry unit to combat incitement and perceived disruptions to Prime Minister Ariel Sharon’s disengagement plan.

Yesterday's government decision stipulates that the unit will be responsible for “legal proceedings against incidents of incitement to violence, rebellion and protest activities - including blocking roads, holding unauthorized demonstrations and threats against public servants - in the context of the struggle against the disengagement.”

Read the whole piece - there are additional, and much more shocking details.

2. Throttling legitimate dissent II

From JPost:

Parents to be prosecuted for endagering [sic] children

The Justice Ministry has decided to prosecute parents, and others responsible for minors in cases where the child is endagered [sic] so that the guardians may protect themselves from being arrested or evacuated by law enforcement officials.

Borrowing the modus operandi of tyrannies, the Israeli speaks in code - with a forked tongue.

Another JPost on the same topic is entitled, "Police to probe settlers' use of kids in protests". I have to surmize that JPost loves the story so much, they published two version in one day!

3. Shabak detains Netivot City Councilman During DM Mofaz's Visit

From IMRA:

Correspondent Danny Shalom reports in today's edition of Hazofe that two Shabak (ISS) agents ordered Likud Central Committee member and Netivot Municipal Councilman Chaim Shalom not to leave a room in the offices of the municipality during the course of a half hour visit by Minister of Defense (Likud) Shaul Mofaz.

A spokesperson for the Shabak explained to the Danny Shalom that "we had received information that Mr. Shalom planned to interfere during the course of the meeting between municipal officials and Minister Mofaz and in light of this it was brought to the attention of the Police. Mr. Shalom was not imprisoned by the Shabak guards."

Note: "Resistance News" is a daily column devoted to news about the Jewish resistance to Sharon's expulsion and resettlement plan. Let it not be said that IsraPundit observed the ethnic-cleansing of Jews in Yesha and reacted with indifference.

Justice Versus Jurisprudence

Is the dissent legitimate? It's difficult for me to reconcile my strong belief that Israel needs a modern parliamentary government and also say the current governing apparatus allows for legitimate dissent. The incitement statute alone proves this.

Blocking roads is not legal in Israel. Incitement can be prosecuted. Unauthorized demonstrations are illegal. Threats against public servants [sic] are unlawful. Administrative detention is legal.

Law and justice are not the same. Aviad Visouly agres with this. Arutz Sheva quotes him: "the courts; and not the police, must set..the explicit guidelines as to where the borders of freedom of expression lie.".

Only a modern government can meet the requirements of all the parties. The rest is just a delay while Israel shrinks.
