    Jimmy Carter is sued for lying about Israel

    I met Nitsana Darsha-Leitner in Toronto almost 10 years ago. She was just out of law school and had come to talk about her pioneering lawsuits on behalf of victims of terror.

    She just sent me a press release, which is below, announcing her latest lawsuit in which she is suing Jimmy Carter et al for violating NY commerce law by publishing lies. She has fashioned the suit as a class action on behalf of all those who bought the book and were thus harmed. This is no small matter.

    I wonder how many other organizations and people can be sued for the same thing.

    Wikipedia has this to say about her great impact and success.

      Since 2003 Darshan-Leitner and a team of lawyers have worked with hundreds of terror victims in lawsuits [3] and legal actions against Hamas, the Palestinian Authority, Iran, Syria,[4] Islamic Jihad and numerous financial institutions.[4] The cases are litigated in the Israeli, American, Canadian and European courts.

      Darshan-Leitner has been involved in a wide-range of legal actions in Israel.[5] and abroad on behalf of Jewish rights cases[6] In total she has won judgments of over $702 million against organizations such as the Palestinian Authority.

      In February 2002 Darshan-Leitner was awarded $183 million from Iran by a U.S court for Iran’s role in a Hamas suicide bombing in Jerusalem.

      In September 2006, Darshan-Leitner and New York attorney Robert Tolchin filed a law suit in federal court on behalf of the families of 12 missing Jewish-Iranians against the former Iranian President Mohammad Khatami. Khatami has refused to answer the complaint and has defaulted the case.

      In January 2008, she filed a lawsuit for NIS 260,000,000 ($65,000,000 US) against the Egyptian Government in a court in Beersheba on behalf of ten families of Sderot (Israel) whose relatives were killed or seriously injured by Palestinian Kassam rockets.

      In May 2008, Shurat HaDin was co-counsel in filing in Manhattan Federal Court against Swiss mega bank UBS GA[5] which is accused by the plaintiffs of financing terror. Included amongst the plaintiffs were three families who were physically and emotionally harmed by the Katyusha rockets launched by Hizbollah into Israeli cities during the 2006 war with Lebanon. Attorneys for UBS have denied the allegations and said they would vigorously defend the law suit.

      In June 2008, the families of 12 missing Iranian Jews filed a petition in the Israeli High Court of Justice seeking to block the Israeli government from releasing information on the fate of four disappeared Iranian diplomats as part of the prisoner release deal with Hizbollah. The Iranian diplomats were captured by Christian militia forces, the Samir Jaja faction, in South Lebanon in 1982. The families are represented in the court proceeding before the High Court by Darshan-Leitner.

      In July 2008, Darshan-Leiter received word from the Israeli High Court of Justice that the petition was being dismissed as the issue was one of “diplomatic concern.” The court did however point a harsh finger at Israeli PM at the time, Mr. Ehud Olmert, with an expectation that the “matter not be pushed assunder.” Darshan-Leinter then turned to the PM with a request by the families for an urgent meeting before the deal went through. Receiving no response, Darshan-Leiter then turned to all 120 members of the Israeli Parliament, The Knesset, asking that they remember the 12 Missing Jews of Iran in their speeches and activities throughout their term of service.

      In July 2008, the Center joined with Montreal-based attorney Jeffrey Boro and Professor Ed Morgan of the University of Toronto’s International Law and Counter-Terrorism Project to file a civil action by Canadian victims of Hizbollah. The law suit.[7] contends that since 2004, the Lebanese-Canadian Bank (LCB), formerly the Lebanese branch of the Royal Bank of Canada, permitted the Yousser Company for Finance and Investment and the and Martyrs Foundation, two Lebanese organizations recognized by the United States as active terrorist groups, to open and maintain accounts at the bank. The suit alleges that LCB allowed the two groups to freely transfer many millions of dollars of Hizbollah funds and to carry out millions of dollars in financial transactions, within and without Lebanon, by means of wire transfers, letters of credit, checks and credit cards provided by LCB. LCB, the suit charged, facilitated Hizbollah’s terrorist activities and is liable to the plaintiffs for the harm that has been inflicted upon them and their families in the rockets attacks launched by Hizbollah on civilians in Northern Israel in the year 2006. Darshan-Leitner claimed in filing the suit that LCB knew that both charities are part of Hizbollah’s financial arm and that by providing them banking services they were really assisting the Iranian backed terrorists in Lebanon and their rocket attacks against civilians.

      On July 14, 2008, Darshan-Leiter and Attorney Robert Tolchin of New York filed a civil action on behalf of victims of the Hizbollah against an American Bank. The action was filed in the New York State Supreme Court in Manhattan Representing 85 victims and their family members, the law suit[8] alleges that the American Express Bank, Ltd. and the Lebanese-Canadian Bank (LCB) unlawfully executed millions of dollars in wire transfers for Hizbollah between 2004 and 2006. The plaintiffs assert that Hizbollah used the funds transferred by AMEX Bank and LCB to prepare and carry out the rocket attacks which the terrorist organization rained on Israeli cities between July 12 and August 14, 2006.

      The plaintiffs rested their claims in part on written findings issued by the New York State Banking Department in 2007, which determined that AMEX Bank had failed to establish adequate procedures to prevent terrorism financing as demanded by state and federal law. This is the first lawsuit brought by terror victims against an U.S. financial institution that serves as a correspondent for a bank in Lebanon. Darshan-Leitner told the Associated Press that “the idea of the lawsuit in part is to warn American correspondent banks that they will be held responsible for attacks by Hezbollah if they transfer money to them,” Darshan-Leitner said. “We expect them to follow the law.”

      On August 21, 2008, over 100 victims of terrorist attacks carried out by the Hamas and Palestine Islamic Jihad (“PIJ”) terror organizations in Israel filed a civil action in Los Angeles Superior Court against China’s largest bank, the Bank of China Ltd. (“BOC”). The suit, Zahavi v. Bank of China, seeks both compensatory and punitive damages. The plaintiffs allege in their complaint that starting in 2003, BOC executed dozens of wire transfers for the Hamas and PIJ totaling several million dollars. In April 2005, Israeli counterterrorism officers met with officials from the Chinese Ministry of Public Security and China’s Central Bank regarding these Hamas and PIJ wire transfers. The Israelis demanded that the Chinese officials take action to prevent BOC from making any further such transfers. Despite the Israeli warnings, the BOC – with the Chinese government’s approval – continued to wire terrorist funds for the Hamas and PIJ. The plaintiffs are represented by attorneys Federico C. Sayre of Los Angeles, Robert J. Tolchin of New York and Darshan-Leitner.



    NEW YORK: An historic class action suit has been filed against former President Jimmy Carter and the Simon & Schuster publishing company alleging that Carter’s book, Palestine: Peace Not Apartheid, contained numerous false and knowingly misleading statements intended to promote the author’s agenda of anti-Israel propaganda and to deceive the reading public instead of presenting accurate information as advertised. The suit, captioned Unterberg et al. v. Jimmy Carter (11 cv 0720), filed in the United States District Court for the Southern District of New York, seeks compensatory and punitive damages.

    The plaintiffs, who hope to have the case certified as a class action, are members of the reading public who purchased Carter’s book expecting that they were buying an accurate and factual record of historic events concerning Israel and the Palestinian Arabs. The lawsuit contends that Carter, who holds himself out as a Middle-East expert, and his publisher, intentionally presented untrue and inaccurate information and sought to capitalize on the author’s status as a former President to mislead unsuspecting members of the public. The complaint alleges that the defendants’ misrepresentations, all highly critical of Israel, violate New York consumer protection laws, specifically New York General Business Law § 349, which makes it unlawful to engage in deceptive acts in the course of conducting business. While acknowledging Carter’s right to publish his personal views, the plaintiffs assert that the defendants violated the law and, thus, harmed those who purchased the book.

    The suit is the first time a former President and a publishing house have been sued for violating consumer protection laws by knowingly publishing inaccurate information while promoting a book as factual.

    The plaintiffs are represented by attorney David Schoen, Esq. of Montgomery, Alabama and attorney Nitsana Darshan-Leitner, Esq. of Tel-Aviv, Israel.

    The complaint notes that after the book’s publication some of Carter’s closest aides, including distinguished public officials and scholars personally involved in the events described, condemned the book as untruthful. Despite being presented with irrefutable proof that many of representations in the book are false, the defendants have refused to make any corrections.

    Attorney Schoen stated that:

      “It is, indeed, a sad day for all of us as Americans, when a former President demeans the dignity of his office by intentionally misstating critically important facts concerning events of great historic significance and public interest, simply to advance a personal anti-Israel animus and to foster the agenda of the enemies of Israel who pump so much money into the Center which bears his name.”

    Attorney Darshan-Leitner stated that:

      “The lawsuit will expose all the falsehoods and misrepresentations in Carter’s book and prove that his hatred of Israel has led him to commit this fraud on the public. He is entitled to his opinions but deceptions and lies have no place in works of history.”

      Glad to hear that someone is fighting for justice in the way that hurts these various thug organisations where it hurts.. funding. Jimmy Carter deserves a slap-down as well.. his BLATANT anti-Semitism is disgusting and an embarrassment to America. He peddles lies about Israel and in so doing subverts US policy in the region, giving “aid and comfort to our enemies”. It is my hope that this suit goes forward and wins a substantial judgement.       After the disturbing news from Egypt, it’s nice to hear this. The guy that brought Sadat and Begin together at Camp David forever blamed Israel for not wanting peace. So why has this peace, however cold, existed with Egypt and Jordan for a number of decades?

      I don’t know but I have a gut feeling that he got a lot of funding for his Presidential Library from some very wealthy Arabs which has influence his way of thinking. And it doesn’t improve my all time low opinion of what I consider the worst president in history reading

      Any former or present President compared to Carter is an insult IMHO.

      I need some clarity on this…Other than to call Carter an anti-Semite and to state he does not have the freedom to his own personal observations, I am missing the reason for the uproar.

      For example, the Suit states on page 10:

      On page 215 Carter writes: “An option for Israel is to withdraw to the 1967 border specified in UN resolution 242″

      OK. the suit contends this is not what the resolution states, therefore he is a liar and an anti-Semite….

      So I pulled up UN Resolution 242 and it states:

      1) Affirms that the fulfillment of Charter principles requires the establishment of a just and lasting peace in the Middle East which should include the application of both the following principles:

      (i) Withdrawal of Israel armed forces from territories occupied in the recent conflict;

      (ii) Termination of all claims or states of belligerency and respect for and acknowledgment of the sovereignty, territorial integrity and political independence of every State in the area and their right to live in peace within secure and recognized boundaries free from threats or acts of force.

      So according to Article (i), I am completely missing how Carter’s assessment is this massive anti-Semitic lie?

      End of the day, I have never been a fan of Carter’s Baptist Evangelical roots, which actually make him pro-Israel, but I believe labeling him a liar and anti-Semite based on what I read in the suit is a stretch.

      Mark, its really very simple.All informed people, particlarly past presidents, know that Israel was to see to its “Withdrawal of Israel armed forces from territories occupied in the recent conflict” on arriving upon an agreement for secure borders and that it was never contemplated that she is required to withdraw to the ’67 borders.

      So when Carter writes that Israel has the option “to withdraw to the 1967 border specified in UN resolution 242“, he is lying. He knows that Res 242 didn’t specify this. He can’t claim ignorance.

      Publishing company Simon & Schuster, which is also targeted in the lawsuit, dismissed it as a frivolous act and a “chilling attack on free speech that we intend to defend vigorously.”

      “This lawsuit is frivolous, without merit, and is a transparent attempt by the plaintiffs, despite their contentions, to punish the author, a Nobel Peace prize winner and world-renowned statesmen, and his publisher, for writing and publishing a book with which the plaintiffs simply disagree,” Simon & Schuster spokesman Adam Rothberg told the Washington Post.

      I am glad they are defending. This case is all about the truth. Carter must substantiate what he wrote. He can’t plead ignorance.

      Jimmy Carter is a despicable human being, a congenital prevaricator and champion of far left wing causes. It is about time someone took him to task, even though such a lawsuit is a daunting task given the US First Amendment which protects even scumbags like Carter from saying the most vile things.

      Calling Jimmy Carter an anti-Semite is to miss the point. He is pro-totalitarian while pretending to be pro-democracy. Jimmy Carter has never met a totalitarian dictator he could not support. In a recent column by Mona Charen, she writes:

      In fact, no former president including Richard Nixon has behaved as dishonorably as Carter. His post-presidency has been marked by truckling to America’s enemies (North Korea, Syria, the PLO, Nicaragua) and actively impeding U.S. foreign policies of which he disapproved. Before the first Gulf War, for example, when President George H. W. Bush was attempting to assemble an international coalition to expel Saddam Hussein from Kuwait, Carter wrote a letter to the U.N. Security Council urging members not to cooperate with the U.S.

      Carter’s apologies for the United States make Obama’s seem chauvinistic. Meeting with Haiti’s dictator Raoul Cedras, Carter allowed as how he was “ashamed of what my country has done to your country.” And explaining why other Americans took a skeptical view of Syria’s Hafez al-Assad and North Korea’s Kim II Sung, both of whom, he wrote, “have at times been misunderstood, ridiculed, and totally condemned by the American public,” Carter surmises that this is in part because “their names are foreign, not Anglo-Saxon.”

      And then there is Carter’s festering abhorrence of the Jewish state, which reached its fullest expression in “Palestine: Peace Not Apartheid.” The title expresses his sympathies and antipathies succinctly. It’s a book about a land — Israel — that Carter would prefer become “Palestine.” How else to interpret the latter part of the title — “Peace Not Apartheid”? The leftist/Islamist slur against Israel is that it is a racist, apartheid state akin to South Africa and therefore lacking in legitimacy. Carter embraces this calumny.

      I am a huge fan and, as usual, your piece on the Carter lawsuit is well written and supported and right on; but this time that is so in all but one regard: You begin by acknowledging that Carter deserves to be sued, but end by asserting that a law suit is not appropriate because the First Amendment trumps all.

      With all due respect, the case has nothing at all to do with the First Amendment and, I am afraid, you have fallen for this canard, offered self-righteously by Simon & Schuster, where it has no place or because writing is relevant to the matter, your journalistic instinct trumped reason and you reacted in knee jerk fashion in this one instance, rather than carefully analyzing the nature of the matter.

      I must tell you that I am a First Amendment absolutist. In my practice, I defend the First Amendment (and other Amendment) of all who come to me, including the KKK in a prominent march case successfully challenging and anti-masking law. It is for that reason that I took the extraordinary step in the Complaint in this lawsuit of writing an introduction which explained what the case was not, as much as what it is. As I wrote in the Complaint itself, the case is not in any way a challenge to Carter’s right to write or S and S’s right to publish whatever Carter wishes to spew, however anti-Israel or pro anything else his speech or writing might be. He has the right to lie, to advocate, to write or say whatever he wishes so far as I am concerned and the lawsuit expressly notes that. What the lawsuit asserts is that neither he nor Simon and Schuster has the right to entice people to part with their hard earned money by hawking a product to them which is not at all what it was advertised to be when targeting the audience they targeted.

      Take the consumer’s part for a moment. You have $27 you want to invest to learn the truth about the Middle East, the “peace process” and other related historical events. You want the real facts so that you can decide who is right, who is reasonable, who did and said what and so on. You see an advertisement for the book on this exact subject that the publisher touts as being the definitive such piece, written by none other than the former President of the United States who was at the heart of it all, and it is represented as “completely accurate” in every regard – a reporting of the very historical events you want to study. You give your $27 to S and S (Carter gets his share) and you have your book.

      But now, you read that Carter’s closest confidantes and aids, experts in this field, and the very people involved in the events depicted in your book, who knew the facts about who said what in these meetings, who drew up which maps, who offered what, have all written that your book is not true at all – that it is filled with lies and false depictions of the events, that it reflects things that never happened, misrepresents historical events, omits much of the truth, and so on. Indeed, you read from each of them that what Carter has done is complete anathema to them, such that they feel compelled ethically and otherwise to completely disassociate themselves from Carter in every way, to denounce what he has done, to acknowledge that he did it to foster his agenda which requires misleading to advance the position of those enemies of Israel who fund his Center and his work. You realize you have been had, swindled, taken, by an advertising campaign that was not true.

      You also come to find out that Simon and Schuster were presented with the truth from these experts and former Carter confidantes who decried the lies, misrepresentations, and half-truths and the danger those posed; but that S and S refused to correct a thing and that Carter went on a speaking tour reiterating that everything in the book was “completely accurate” well knowing that was not so.

      Putting aside that the publisher should be mortified and should offer all a refund, you want your money back. You had $27 to spend to buy the book that would give you the facts, you relied on the claim by Carter and S and S that this is what their product did and that was a lie. You want your money back, so you can buy a book that will teach you or to do with what you please. You also would like a judge to say what they did to con you and others into buying something that was not what it was claimed to be was wrong, and you would like them to be punished and deterred from trying to trick other people.

      That, Ms. Charen, is all that this case is about. I would think you would support that kind of effort by the little guy consumer just to demand the right and honest thing. The First Amendment gives Jimmy Carter the right to spew whatever he likes on any subject, true or false and our consumer would agree and does not in any way challenge his right to write this book. Sell it as a novel though, not as the truth concerning the events depicted. As Dennis Ross and Ken Stein wrote, the errors are not matters of opinion or interpretation – they were plainly and simply falsehoods concerning historical events. It is a shame a former President would demean the office he held by engaging in such conduct, but his right to do so is not at issue in this case. It is about the false marketing and the law’s protection of the consumer from such trickery.

He is a mass genocidal murderer with blood of millions of Iranians on his filthy hands. It was Jimmy Carter who in 1979 overthrow the pro-western progressive Shah of Iran. Carter according to Dr. Mike Evans who knows Iran Israel & the Middle East is the God father of the Islamic revolution in Iran. He sent $150 million to the anti-USA terrorist Mullah Khomeini while he was in Paris to overthrow the Shah of Iran. According to Mike Savage, Carter is a criminal that should be imprisoned for his active role in the overthrow of the Shah & the rise of the Islamo-fascists since than. 8 years of needless war between Iran & Iraq with 2 million dead & many more injured, several hundred thousands of systematic arrest torture rape & executions in Iran which has not stopped until now. Assasination of exile, rape & humiliation of women, public flogging hanging & stoning, looting the Iranians wealth & 7 million becoming refugees are amongst the results of the Carter & the British revolution of 1979 in Iran. Is there going to be a day of justice for the people Iran? I do not think so because the USA is in bed with the terrorist regime and Oba-Houssein Osabama the current thug-in-chief in the White House is the protector of Jimmy Carter’s legacy in Iran. Jimmy Carter’s anti-Jewish feelings & his support for terrorists and dictators like Chavez Castro & Ahmadi-nejad, Hezbullah & Hamas leaders should come as no surprise to any decent person.

      The overthrow of the Shah of Iran by Jimmy Carter & Britain might be a taboo subject in the west but it is not their best kept secret amongst us Iranians.

      Caveat emptor is what governs buying such a book by a well known political prevaricator like Jimmy Carter.

      If a grown person is stupid enough to not know that Jimmy Carter lies constantly about a variety of issues, and is thereby stupid enough to part with $27 for something written by this proven prevaricator, they then cannot sue in court for compensation.

      You would turn all advertising and commerce in a free society on its head if your reasoning prevails.

      The case is probably not winnable but if it goes to trial Carter can be shown in a showcase trial before the whole world that he is a liar and a vile anti-Semite. His name and reputation and even his income will be degraded. I assume without having the facts that this is the motivation of the plaintiffs. Maybe he will lie under oath?

      I wouldn’t bet it won’t go to trial. She can prove intrinsic damages incurred by Israel and Israelis due to lies and purposeful revisionist history. If an advertiser claimed that cigarettes were beneficial to one’s health they would be sued by everybody and lose. False claims leading to specific damages is litigious.

      Your comments on Glenn Beck are on the same page as George Soros, the 400 liberal Rabbis and Hamas. No conservative supporter of Israel would do anything other than praise Glenn Beck for his steadfast support of Israel and the evidence he has produced to support his opinions.
