Berg doen’t get into the definition of “natural born citizen” here. The Constitution requires that a person to be eligible to be President,must be a “natural born citizen”. The Court would have to decide what that term means as it is ambiguous or uncertain. To do this it would look at the intent of the legislators at the time as disclosed by what they have written. The Federalist papers clearly say that such a person must be born to two U.S. citizens. Obama’s father was not a US citizen. WHAT ABOUT OBAMA’S INDONESIAN CITIZENSHIP?
(Lafayette Hill, PA – 04/28/11) – Philip J. Berg, Esquire, the first Attorney who filed suit against Barack H. Obama on August 21, 2008 challenging Obama’s lack of “Constitutionally Eligibility” to serve as President of the United States stated that Obama’s release of this document that Obama calls his long form Birth Certificate raises further questions of the legitimacy of the document itself. Moreover, even if it were a legitimate birth certificate, which it is not, it still does not answer the question of Obama’s Constitutional Eligibility.
Berg said, “The Birth Certificate issued by Obama on national Television, have missing factors: Mother’s address; length and weight of baby; and where the signature of Stanley Ann Dunham appears, it says “mother or informant”. Additionally, the authenticity of the document itself is already being questioned for many reasons”
Berg continued, “Even if Obama could produce a long form Birth Certificate, which is highly doubted, it fails to answer the questions into Obama’s adoption in Indonesia.”
Berg said, “I have received many calls claiming Obama could not have lost his U.S. citizenship by his mother’s acts of expatriation. In part this is true, however, the Nationality Act of 1940, revised 1952, Section 318(a) states,

“A former citizen of the United States expatriated through the expatriation of such person’s parent or parents and who has not acquired the nationality of another country by any affirmative act other than the expatriation of his parent or parents may be naturalized upon filing a petition for naturalization before reaching age of Twenty-Five [25] years and upon compliance with all requirements of the naturalization laws with the following exceptions:
(b) No former citizen of the United States, expatriated through the expatriation of such person’s parent or parents shall be obliged to comply with the requirements of the immigration laws, if he has not acquired the nationality of another country by any affirmative act other than the expatriation of his parent or parents, and if he has come or shall come to the United States before reaching the age of twenty-five years.
(c) After his naturalization such person shall have the same citizenship status as if he had not been expatriated.”
Berg continues, “Renewing an Indonesian Passport after the age of 18 is an affirmative act, as you are swearing allegiance to another Country. Soetoro/Obama renewed his Indonesian Passport when he traveled to Pakistan that is why he had to stop in Indonesia first. Remember, in 1981, Dunham was divorcing Soetoro in Hawaii and was not in Indonesia. Obama/Soetoro admits to traveling to Indonesia first and then onto Pakistan. Soetoro/Obama claims in his book “Dreams from my father” that he stopped in Indonesia to visit his mother. But again, his mother was not in Indonesia, she was in Hawaii with Maya, divorcing Lolo Soetoro. In addition, the State Department has stated in response to a FOIA [Freedom of Information] request that they do not have a U.S. Passport application on file for Barack H. Obama.”
Berg said, “Despite the above however, Indonesia required Obama/Soetoro to do a bit more upon his 18th birthday. In fact the Indonesian law gives until the age of Twenty-One [21]. Soetoro/Obama would have had to sign an Affidavit relinquishing his Indonesian citizenship and said Affidavit had to be sent to the Indonesian Government before reclaiming any U.S. citizenship he may have once held.
When it comes to the citizenship of individuals in other countries, we are prevented from interfering, Hague Convention 1930. During the late 60?s all the way up until 2006 Indonesia did not allow dual citizenship. In 2006, Indonesia changed their laws to permit dual citizenship; however, Indonesia has had its battles with enforcing their new law permitting dual citizenship.
From the legal research we have done, it appears that Soetoro became an Indonesian citizen. When Soetoro/Obama was approximately four [4] years old his parents divorced and thereafter, Soetoro/Obama’s mother, Stanley Ann Dunham, married Lolo Soetoro, a citizen of Indonesia. Evidence points to the fact that Lolo Soetoro either signed a government form legally ‘acknowledging’ Soetoro/Obama as his son or ‘adopted’ Soetoro, either of which changed any citizenship status Soetoro/Obama had to a “natural” citizen of Indonesia.
At the time Barry Soetoro was in Indonesia, all Indonesian students were required to carry government identity cards or Karty Tanda Pendudaks, as well as family card identification called a Kartu Keluarga. The Kartu Keluarga is a family card which bears the legal names and citizenship status of all family members.
Soetoro/Obama was registered in a public school as an Indonesian citizen by the name of Barry Soetoronot allow foreign students to attend their public schools in the late 1960’s or 1970’s, and any time a child was registered for a public school, the child’s name and citizenship status were verified through the Indonesian Government.
See no way for Soetoro/Obama to have attended school in Jakarta, Indonesia legally unless he was an Indonesian citizen, as Indonesia was under tight rule and was a Police State. See Constitution of Republic of Indonesia (Undang-Undang Dasar Republik Indonesia 1945), Law No. 62 of 1958. These facts indicate that Obama/Soetoro is an Indonesian citizen, and therefore he is not eligible to be President of the United States. and his father was listed as Lolo Soetoro, M.A according to the Indonesian school records. Indonesia did Constitution of Republic of Indonesia (Undang-Undang Dasar Republik Indonesia 1945), Chapter 13, Law No. 62 of 1958 (all citizens of Indonesia have a right to education).
Under Indonesian law, when a male acknowledges a child as his son, it deems the son, in this case Soetoro/Obama, an Indonesian State citizen. See Constitution of Republic of Indonesia, Law No. 62 of 1958 concerning Immigration Affairs and Indonesian Civil Code (Kitab Undang-undang Hukum Perdata) (KUHPer) (Burgerlijk Wetboek voor Indonesie).
Furthermore, under the Indonesian adoption law, once an Indonesian citizen adopts a child, the adoption severs the child’s relationship to the birth parents, and the adopted child is given the same status as a natural child and the child takes the name of his step-father, in this case, Soetoro. See Indonesian Constitution, Article 2.
The Indonesian citizenship law was designed to prevent apatride (stateless) or bipatride (dual) citizenship. Indonesian regulations recognized neither apatride nor bipatride (stateless or dual) citizenship. Since Indonesia did not allow dual citizenship; neither did the United States (since the United States only permitted dual citizenship when ‘both’ countries agree); and since Obama/Soetoro was a “natural” citizen of Indonesia, the United States would not step in or interfere with the laws of Indonesia. Hague Convention of 1930.”
As a result of Soetoro/Obama’s Indonesian ‘natural’ citizenship status, Soetoro/Obama could never regain U.S. ‘natural born’ status, if he in fact he ever held such, which we doubt. Soetoro/Obama could have only become ‘naturalized’ if the proper paperwork were filed with the U.S. State Department, after going through U.S. Immigration upon his return to the United States; in which case, Soetoro/Obama would have received a Certification of Citizenship indicating ‘naturalized’.
Berg continued, “Regardless, we have been unable to locate any records indicating that Soetoro/Obama attempted to and/or actually did take the proper steps through the State Department in order to be here in our Country legally”
Further, there is no evidence that Soetoro/Obama ever ‘legally’ changed his name from Barry Soetoro to Barack Hussein Obama – therefore his legal name is still ‘Barry Soetoro’.
There’s an old Chinese proverb, “Three men make a tiger“. The meaning behind it, is that if enough people say something is true, even if a person knows the thing to be untrue, he will be swayed by the opinions of the others. In the US, we have every major news outlet saying that Barry Soetoro is actually Barack Obama, and is a natural-born US citizen; even though, as Mr. Berg points out, we know this to probably be untrue.
I’m mostly a radical centrist. Sometimes I vote for Republicans. Sometimes I vote for Democrats. It all depends on the issues and what I think of the candidates.

I came to a conclusion some time ago that Obama was not born in the United States. I’ve read the comments of his Kenyan father’s family who all say his American mother, Stanley Ann Obama, who gave birth to Barack Hussein Obama II at age 18, was in Kenya the day it happened. Since a bunch of Kenyan peasants have no particular reason to lie about these matters, I believe them. For me, this was also confirmed by a news report that the US State Department, following a freedom of information court order that had been long delayed, released information on Stanley Ann’s passport. The information included a regretful official comment that the official trail of one of her trips, which involved a Kenyan visa stamp that would have placed her there in time for BHO2?s birthday, had been destroyed. For some unknown reason, they reported. That told me all I needed to know.
Governments lie all the time, and they always do so at the command of the Mister Big of the moment, who commands the services of dirty trick crews who would have put a smile on the faces of Richard Nixon just before the Watergate break-in, and maybe one Josif Stalin as well, whenever he needed to cook up some “evidence” against one of his own Politburo members whom he intended to have liquidated after a brief show trial.
So here’s my summation of what I think we’ve got here. I think he was born in Kenya, and not long afterward was carried off to Indonesia by his weird 1960s mother, where he was raised more or less the same as any Moslem: Sun’a, I presume. Then in later years, his handlers probably thought it more convenient to stick him into a black leftist south side Chicago church, under the ministrations of the Reverend Dr Wright, whose hate-Whitey and hate-America outlook doesn’t much differ from that of any of his counterparts in the more hateful end of Islam.
I could have voted for Barack Hussein Obama if he were a real Moslem. Or a real Christian. Or real Jew, real Atheist, or whatever. And his being black made no damned difference to me. I spent my childhood in the Hyde Park neighborhood of Chicago, which was one of the few racially integrated places in the whole of America in 1939 and 1940 when I was a kindergarten age child there. And these days, I’ve become a fan of Allen West, who’s an honored US military veteran, a conservative, and an elected official, in Florida, I think.
But Barack Hussein Obama II? I wouldn’t even use him as a mop to clean my kitchen floor. Because I don’t even remotely respect liars and chiselers.

The CIA and INTEL agencies have the ability to create an identity for anyone and this LONG FORM that Obama produced was produced by a government computer software program – a hoax. Only gullible people would accept this as a legitimate birth certificate.
The signatures are too perfect on a modern document. You also have to look at the typeset/typewriter used in that hospital from that era and verify the signatures as a match.
It is possible that government computer hackers have the ability to mimic original signatures in order to produce this FAKE document that Obama spent $3 million in court fees NOT to produce! OVer two years Obama spent $3 million in court to not have to present his long form and NOW it suddenly appears with him smiling like you are all fools!
You won’t be able to prove it though – this is Obama’s government clowns putting this together. But the real argument is that this would have impeached Obama according to the US Constitution and once again, Obama lies, cheats and steals and exploits the American people.

Arnold, it would be nice to have more details, facts on this incident(eg the news report source, etc.). I thought that the only way you lose US citizenship is to formally renounce it at an embassy, or the like. However, there definitely appears to be evidence pointng to an Indonesian passport acquired as an adult. this would probably jibe with withheld school records showing him as a foreign student.
Sorry, but the time to shut the barn door was before the horse got out. The issue of whether Obama is eligible to be president is now MOOT because he IS president, and it would take impeachment proceedings to even try to oust him, at which he would have the defense that the American People, Congress, and the Supreme Court have already granted him an EXEMPTION

I was watching Chris Matthews on MSNBC, who’s been in the news business his whole life, and he remembers Obama from ten years ago, saying who the hell has a name like that! It was Lawrence Tribe, a law professor at Harvard, who told him about this guy Obama who was so damned smart it was unbelievable. It is true very smart people, like Albert Einstein, can see things normal people can’t. Maybe they can see farther, deeper or wider… Albert said he imagined he was on a flying carpet going through space and looked around to get his ideas. I tried it but everything looked like Star Trek.
Obama can take consolation in the fact Abe Lincoln was attacked like he’s being attacked. Some newspapers called him ape and gorilla even though he wasn’t black. It is a basic law of interpretation that when a Court has to interpret a clause in a document that is ambiguous, that the Court looks outside the document to determine the intention of those that voted for it. In this case, the Federalist Papers and speeches etc.
Secondly the Courts have never heard argument on the merits of the eligibility issue. Instead they have ruled that the Plaintiff did not have “standing” to bring the case.
As it turns out that decision is being appealed and the Court of Appeal (9th Circuit) will hear oral arguments on May 2nd
There is some concern that all 3 judges hearing the appeal, were appointed by Democrats.
If the Cof Appeal rules that they do have standing, then the original case will have to be heard on the merits. This case would allow discovery of all relevant documents and cross examination of Obama.
#7 I agree 100% with your analysis: it’s amazing that there can exist people who believe that the PDF document issued by BHO himself proves anything. The people who believe that have simply no brain. The only way for BHO to prove where he was born and to which parents is to provide the ORIGINAL birth certificate or to show a registration in the original documents of the hospital and/or the state administration of Hawai. Anything else, like this PDF for instance, is nothing but a bad joke. Imagine someone wants to get a new passport in a US consulate around the world saying he’s lost his old one. They will force him to issue to issue an original birth certificate and if he cannot that they will demand a copy of an original registration in the books of the administration.

Your link gives instructions of how to get a US passport in the US while I spoke of the case that you want to apply for a US passport in one of the US consulates around the world. However, I admit that I exeggerated a little, it is probably not necessary to present a copy of the original document, BUT the newly issued certificate has to reproduce the data filled in the administrations register which is a book stored somewhere in the administration. So, concerning Obama, it should be possible to require the State of Hawai to provide insight of these books to an atorney. That’s what I ment.
Jew, the certified form recently publicized by the White House is the “long form”, with all the information required by the State Dept. to verify US citizenship. If you compare that form to the original Hawaiian BC, you’ll see that nothing of relevance is missing.

In 2009, the Indiana Court of Appeals applied Wong Kim Ark and upheld the lower court’s dismissal of a challenge to President Obama’s eligibility.

You are confusing a “natural born citizen” with a nationalized citizen. Example:
Born in the US with at least one US citizen parent – natural born citizen.
Born in the US with no US citizen parents – nationalized born citizen.
Born outside US territory to at least one US citizen parent – nationalized born citizen.
Of the 3 examples above, the children in examples 2 and 3 are not eligible for the Presidency.

Yonatan, please give the devil his due for at least a couple of minutes. This started under Bush, – even the courier who finally led the US Special Forces to Osama was first identified 4 years ago – and the US Special Forces dropped the hammer – but Obummer did give the orders to kill Osama Bin Laden, unlike Bill Clinton, who refused to take him from the Sudan – thrice – and then refused to give the CIA orders to shoot when they had him in their sights over 10 times in Afghanistan – all before Osama had done his worst damage on 9/11.
OK, two minutes over. Now let’s resume trying to kick him out.
The bad news for Obummer bootlickers like Zev is that this shows that Obummer’s ass-kissing of Muslim dictators, and his trademark dithering in almost every other foreign policy issue is deliberate. When he wants to, he can be decisive, as in this case.

Regarding those of you that want Obama gone at any cost, I admit having my own issues with him. If the Dems came up with an alternative progressive that I believed in I would ceertainly support him. However, until that happens, I will be supporting Obama and fight against any RapePublicCon candidate.
As far as Bin Laden is concerned, Obama did what he said he was going to do, including fighting terrorism, unlike your hero Bush 43. W., the great terrorism fighter, let 9/11 happen. Maybe not intentionally, but ignored all of the evidence presentd to him that he could have done something about. Great hero! Then, when he could have gotten Bin Laden in Tora Bora, he pulled out and got us into the Iraq fiasco based on a pack of lies. Lies that were proven to be such before the invasion. And you love to complain about Obama hiding his background. Although it all came out, Bush tried to hide the truth about his arrests, education record, national guard service and pitiful business background. I don’t remember hearing any complaints from the right about any ot those issues.

What Strange-guy and Dan have written is complete dog-poo. Anyone who says Bush “let 9/11 happen” is a total moron who is deliberately making a pretzel from the facts. There was no actionable evidence that was ever presented to Bush. There are hundreds of “leads” that are received every day 99.999% of which are false.
More dog-poo, now rising to the level of a blood libel. The commanders on the ground made a sensible decision to leave the attack on Tora Bora to the locals who knew the territory. It was pure luck that Osama escaped.
It was Bill Clinton who let Osama get as far as he did, first by refusing to take Osama from Sudan, after three offers, because of bogus legal technicalities, and then over a dozen times in Afghanistan when he dithered to give the orders to shoot when the CIA had Osama in their sights. It was Clinton who refused to classify Al Qaeda as terrorists by calling them common criminals. It was Clinton who raised the wall between the CIA and FBI and banned them from sharing intel. It was Clinton who banned the CIA from gathering intel from “unsavory” characters. It was Clinton who refused to retaliate for all the serial attacks during the 90′s which emboldened Osama. He declared war on America in 1996 and again in 1998, and called America a “weak horse” and Al Qaeda the “strong horse”. This is what led directly to the attack on 9/11.
This Strange also repeats the blood libel about the reason for the regime change in Iraq being based on a pack of lies when all the evidence pointed to Iraq’s WMDs, WHICH HAVE NEVER BEEN ACCOUNTED FOR, and were the basis of 17 unanimous UNSC resolutions from 1991 to 2003, which started before Bush was even Governor of Texas.

More brazen lies. The only thing not known about Bush was his one DUI arrest years ago. No US president was vetted by the media more thoroughly than Bush. Dan Rather even ruined his entire career by falsifying the evidence on Bush’s national service on 60 Minutes.
As shown above there was nothing to complain about. On the other hand Barack Obama had hidden not only his birth certificate, he has also hidden his college transcripts and thesis and his medical records. He has also tried to hide all his inconvenient relationships with Islamic terrorist Rashid Khalidi, domestic terrorist Bill Ayers, anti-Semite and anti-American preacher Jeremiah Wright, the voter-fraud organization ACORN, his relationship with convicted gangster Tony Rezko.
In addition, if he is as intelligent as his supporters say he is, he has deliberately taken steps to destroy the US economy and his foreign policy is the laughing stock of the world, including losing the respect of all the Muslim dictators he works so hard to impress.
OK Dr. Strangelove, I read it. What make this site “official” to be making constitutional judgements? Its not a US Gov site, its run by a few individuals and the conclusions reached are not constitutional law, they are the opinions of thw writers of the site. I do not see any case law sited for the conclusions reached.

If impeachment is truly what you have in mind, Bill, i.e., trial for wrongdoing WHILE SERVING IN THE OVAL OFFICE, then you must understand that — notwithstanding its form – Impeachment is not a judicial process, but a political one.
What that means is that howsoever good your ‘case’ against our boy may be, if you haven’t got the senatorial VOTES [because the Senate constitutes the 'jury' in a presidential impeachment], then you’re gonna lose; its just that simple.
On the other hand, if you want him brought up on charges of campaign illegalities — which occurred BEFORE he was inaugurated — that’s not an impeachable offense, but a federal offense for the federal courts to consider.
